Biscomerica Facility Visit

Assemblymember Cheryl Brown and a staffer, made a visit on September 13, 2016, to the Biscomerica facility in Rialto, CA, as a direct result of the recent CAVC legislative trip to Sacramento last May.  Biscomerica resides in the Assemblymember’s 47th District, and she met with Kathy O’Brien and other key Biscomerica management personnel, along with Sandy Larson from NAMA, to discuss issues pertaining to doing business in her district and the state of California. Part of the discussion also included the ramifications of our Snack Tax issue facing vendors in California.

We all felt it was a very productive meeting, and the Assemblymember stated she would return for a tour as her schedule was cut short that day.

DC Fly In – 2016

CAVC participated in the DC Fly-In, NAMA’s The Fly-In, NAMA’s largest and most comprehensive advocacy effort to date that drew participants from 41 states and the District of Columbia.

Meeting discussions focused on three main issues: Nutrition and Wellness, the Small Business Regulatory Flexibility Improvements Act and Sustainability.

At CAVC we’re proud of our member’s work effort, their commitment to success and to our organization but what we’re most proud of is their giving hearts. Every year a Golf Tournament is held to raise money for the CAVC Scholarship Foundation. Throwback to another great outreach hosted by CAVC last December.  At the Dec ’15 CAVC holiday party, we collected donations for the Florence Crittenton house (helps runways, abused babies and children, pregnant teens, etc).  CAVC did an awesome job with donations!

Legislative Day 2016 – Success!

CAVC had another successful Legislative Day May 18th in Sacramento. A group of about 20 people met with over 30 State Senators and Assemble Members to educate them on 3 main points:

1. The Vending Machine Taxes issues where vend operators face a disparity in the law as a result of being left out of the waiver on snack purchase taxes many years ago.

2. CAVC’s opposition to SB 878, a pending bill that would put in place a 21-day “work schedule” to be given to all employees.

3. The burden Prop 65 stickering emergency regulation is putting on Vendors.

In addition, we had a cocktail meeting with Assembly Member Mike Gatto (D-Glendale) and dinner with Diane Harkey, Vice Chair Board of Equalization. Both legislators will work in support of CAVC issues in the future.

CAVC Meets in Vernon, CA

At every CAVC meeting in addition to discussing key political issues and trends within the industry we also make it a point to add in some extra fun and education.

This year’s meeting in Vernon, CA was no exception. In addition to drawing our annual scholarship recipients we also took a tour of Gavina Coffee Roasters.

The Walsh Family CAVC Scholarship Foundation announced the winners of the year 2016 Scholarships.  Each recipient will receive a $5000.00 scholarship towards his or her college education.

To be eligible for the scholarship, the student must: 1) be a full time student at an accredited high school, vocational school, business college, junior college, four-year college, or university, 2) have a passing grade point average of 2.5 or better, 3) be a high school senior, first year vocational student, or first year college student, 4) be an American citizen and a California resident; and 5) be sponsored by a CAVC member company.

This is the 20th year that the Walsh Family CAVC Scholarship Foundation has awarded scholarships.

CAVC in Chicago – Front of Pack Calorie Disclosure

This month CAVC members flew to Chicago for NAMA One Show, the time of year where vendors from around the country unite to learn about the latest trends and laws affecting our industry.

This year, as members from all state councils met the conversation centered on three letters: FOP (Front of Package).

Effective December 1st of this year all product sold in any vending machine needs to have full calorie disclosure listed at the point of purchase (this includes coffee) and affects all vendors with more than 20 machines in the field.

Stay tuned to find out specific regulations and for ideas on how to post calories in real time for the consumer (many of the items you sell are already making the changes on their packaging).

BPA: Know the Facts – TIME SENSITIVE RESPONSE NEEDED

According to Mayoclinic.org, BPA stands for bisphenol A. BPA is an industrial chemical that has been used to make certain plastics and resins since the 1960s. BPA is found in polycarbonate plastics and epoxy resins. Polycarbonate plastics are often used in containers that store food and beverages, such as water bottles. They may also be used in other consumer goods.

In 2015, The Office of Environmental Health Hazard Assessment (OEHHA) listed  BPA as a female reproductive toxicant in their DART-IC review. As a result on May 11th of this year all California Vendors will need to post BPA Warning labels on any machines that vend products that may contain BPA.

Warning labels need to be 5″x 5″ and read:

“WARNING: Many food and beverage cans have linings containing bisphenol A (BPA), a chemical known to the State of California to cause harm to the female reproductive system. Jar lids and bottle caps may also contain BPA. You can be exposed to BPA when you consume foods or beverages packaged in these containers. For more information go to: www.P65Warnings.ca.gov/BPA.”

In Loving Memory of Don Phelps

Don Phelps, a long time member of the California vend industry, passed on March 3, 2016.  Don Phelps started his vending career in 1961 as a sales rep for The Vendo Co. in the Southern California market. He has supported the vend industry as a CAVC member, fund raiser, president,  and active member since the early 1970s. Don was instrumental in the effort to gain sales tax relief in California.  He, along with his many friends and colleagues, spent many hours in Sacramento working for and succeeding in accomplishing legislative sales tax relief for the California automatic merchandising industry.  Don led CAVC fund raising for the  Walsh Family CAVC Scholarship Foundation.   An annual golf outing fund raiser conceived and lead by Don takes place every year in June to raise money for the CAVC Scholarship Foundation .

Don Phelps

1931-2016

Newport Coast resident

 

Donald Lee Phelps, 84, and a 21-year resident of Newport Coast, passed away on March 3, surrounded by his family.  Born September 1, 1931 in Blackfoot, Idaho, Don was one of six children born to Amer Leo and Grace Hoyt Phelps. Growing up during the Great Depression and World War II, Don developed an early positive work ethic with a gift for entrepreneurism.  As a youngster, he sold newspapers, shined shoes and was a golf caddy.  After graduating from West High School in Salt Lake City, Utah, and attending Henager Business College, he enlisted in the U.S. Navy in 1949 and served on both the U.S.S. EPCOR sonar testing ship and the U.S.S. Goss during the Korean War.

After his honorable discharge from the Navy, Don worked in the Southern California food service and vending industries, including his role as general manager of Okeh Caterers. In 1972, he founded Food Systems Inc. headquartered in Buena Park, Calif.  The company celebrates 44 years in business and is still operating throughout Southern California today. As a leader in the food service industry, Don served as president of the California Automated Vending Council (CAVC) and was a member of California Restaurant Association (CRA) and National Automatic Merchandising Association (NAMA).

Over the last five years, Don wrote three books detailing his philosophy on living a life based on morals, ethics, a positive attitude, love of family and love of country. He also authored a handbook for entrepreneurs and business people.

Don was known as a true American patriot, successful businessman, wonderful husband, father, grandfather and great-grandfather, trusted friend, avid fisherman and golfer, Los Angeles Lakers and USC Trojan football fan and lover of jazz.  He is survived by his wife of 43 years, Sally; five daughters: Janet Pirus, Dorothy Henderson, Dana Schaefer, Christine Amsler and Sherri Snelling; son, Tom Snelling and his wife Kelly; seven grandsons, three great-grandsons and one great-granddaughter; sister, Gladys Jennings and her husband Lee and brother-in-law Tom Penfold and his wife Alicia.

Special heartfelt thanks to the staff of Keck Medicine of USC at Newport Beach and Hoag Cancer Center for taking care of Don. Donations may be made in Don’s memory to the Leukemia Lymphoma Society.

He will always be our hero.
